CBSA Culminates Heavy Plate Re-investigation, Unveiling Export Tariffs

The Canada Border Services Agency has finished a re-investigation into the normal values and export prices of certain hot-rolled carbon steel heavy plate and high-strength low-alloy steel heavy plate exported from Chinese Taipei and Germany to Canada. This re-investigation was done to enforce the Canadian International Trade Tribunal's injury finding from February 5, 2021.

On March 22, 2024, the Canada Border Services Agency (CBSA) concluded a re-investigation of the normal values and export prices for specific hot-rolled carbon steel heavy plate and high-strength low-alloy steel heavy plate that was exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei) and the Federal Republic of Germany (Germany) to Canada. This re-investigation was conducted in accordance with the Special Import Measures Act (SIMA) and was initiated on October 19, 2023, as part of the CBSA's ongoing enforcement of the Canadian International Trade Tribunal's (CITT) injury finding issued on February 5, 2021.

The CBSA sent a Request for Information (RFI) to all known importers, exporters, producers, and vendors at the start of the re-investigation to gather information on the costs and selling prices of subject goods and like goods. This information was used to update the normal values and export prices for subject goods imported into Canada. The CBSA also conducted on-site verifications at the premises of one exporter in Chinese Taipei and one exporter in Germany.

Normal values are typically determined based on the domestic selling prices of like goods in the country of export, or on the aggregate of the cost of production, a reasonable amount for administrative, selling and all other costs, plus a reasonable amount for profits. Export prices are generally determined based on the lesser of the adjusted exporter's sale price or the adjusted importer's purchase price, with necessary adjustments made by deducting costs, charges, expenses, duties, and taxes resulting from the exportation of the goods.

For China Steel Corporation, a manufacturer and exporter of subject goods located in Kaohsiung City, Chinese Taipei, normal values were determined based on the company's weighted average domestic selling prices of heavy plate in Chinese Taipei, or on the aggregate of the cost of production, a reasonable amount for administrative, selling and all other costs, plus a reasonable amount for profits. Export prices were determined based on the exporter's selling price less all costs, charges, and expenses resulting from the exportation of the goods.

Similarly, for Aktien-Gesellschaft der Dillinger Hüttenwerke (Dillinger), a manufacturer and exporter of subject goods located in Germany, normal values were determined based on the company's weighted average domestic selling prices of heavy plate in Germany, or on the aggregate of the cost of production, a reasonable amount for administrative, selling and all other costs, plus a reasonable amount for profits. Export prices were determined based on the exporter's selling price less all costs, charges, and expenses resulting from the exportation of the goods.

For all other exporters in Chinese Taipei and Germany, normal values will be determined by ministerial specification. The normal values for future shipments determined by ministerial specification are calculated by advancing the export price of the goods by 80.6% for Chinese Taipei and 68.6% for Germany, pursuant to subsection 29(1) of SIMA. Normal values previously in place expire on March 22, 2024.

The CBSA cautions all parties that if there are increases in domestic prices and/or costs, the export price for sales to Canada must be raised accordingly to ensure that any sale to Canada is not only above the normal value but also at or above the selling prices and total costs and profit of the goods in the exporter's domestic market. Failure to properly notify the CBSA of such changes, adjust export prices, or provide the necessary information for making adjustments to normal values and export prices may result in retroactive assessments of anti-dumping duties.

Conclusion:
In summary, the CBSA has concluded its re-investigation into the normal values and export prices of certain hot-rolled carbon steel heavy plate and high-strength low-alloy steel heavy plate exported from Chinese Taipei and Germany to Canada. The re-investigation has resulted in the determination of specific normal values and export prices for China Steel Corporation and Aktien-Gesellschaft der Dillinger Hüttenwerke, while normal values for all other exporters will be determined by ministerial specification. Exporters and importers are advised to ensure compliance with the updated normal values and export prices to avoid potential retroactive assessments of anti-dumping duties.
